Centrālā vēlēšanu komisija (CVK) piektdien, 2022.gada 23.septembrī nolēma atteikt politiskās partijas “Latvijas Krievu savienība” iesniegtā likumprojektu “Par 2022.gada 16.jūnija likuma “Par padomju un nacistisko režīmu slavinošu objektu eksponēšanas aizliegumu un to demontāžu Latvijas Republikas teritorijā” atcelšanu” reģistrāciju, jo vairākums no komisijas locekļiem uzskatīja, ka likumprojekts pēc satura nav uzskatāms par pilnīgi izstrādātu.
Saskaņā ar likumu “Par tautas nobalsošanu, likumu ierosināšanu un Eiropas pilsoņu iniciatīvu” CVK lēmums jāpieņem 45 dienu laikā no likumprojekta saņemšanas dienas, izvērtējot iniciatīvas grupas atbilstību likuma prasībām un to, vai likumprojekts ir pilnībā izstrādāts pēc formas un satura.
Atbilstoši tiesu praksei likumprojektu nevar uzskatīt par pilnīgi izstrādātu pēc satura, ja tas paredz izlemt tādus jautājumus, kuri vispār ar likumu nav regulējami, vai kuri pieņemšanas gadījumā nonāktu pretrunā ar Satversmē ietvertajām normām, principiem un vērtībām vai Latvijas starptautiskajām saistībām.
Pēc CVK lūguma viedokli par rosināto likumprojektu sniedza Tieslietu ministrija un Saeimas Juridiskais birojs. Tieslietu ministrijas atzinumā bija norādīts, ka likumprojekts nav izstrādāts atbilstoši juridiskās tehnikas un Ministru kabineta noteikumos Nr. 108 izvirzītajām prasībām, kā arī likumprojekts, ņemot vērā tā mērķi, pēc sava satura neiekļaujas Latvijas tiesību sistēmā un tā pieņemšanas gadījumā nonāktu pretrunā gan ar Satversmē ietvertajām normām, principiem un vērtībām, gan Latvijas Republikai saistošām starptautiskajām tiesībām, normatīvajiem aktiem vai Latvijas Republikai saistošiem starptautiskiem līgumiem.
Tāpat Tieslietu ministrijas skatījumā likumprojekts nav uzskatāms par iesniegtu atbilstoši Satversmes 78. pantam, jo nav pilnīgi izstrādāts gan pēc formas, gan satura. Tikmēr Saeimas Juridiskais birojs pauda atšķirīgu viedokli, norādot, ka likumprojekta trūkumi nav tādi, kuru dēļ varētu atzīt, ka likumprojekts nav pilnībā izstrādāts Satversmes 78. panta izpratnē.
Iepazīstoties ar viedokļiem un uzklausot likumprojekta iesniedzēja argumentāciju, par likumprojekta noraidīšanu balsoja seši CVK locekļi, bet viens balsoja “pret”.
CVK lēmumu viena mēneša laikā no tā spēkā stāšanās dienas iniciatīvas grupa var pārsūdzēt Augstākās tiesas Administratīvo lietu departamentā.
